End User License Agreement (Google Play)

This End User License Agreement ("Agreement") is a legal agreement between you and the Application Provider ("Licensor") for the software application distributed to you through Google Play (the "Application"). By downloading, installing, or using the Application, you agree to be bound by this Agreement.

Your use of the Application is also subject to the Google Play Terms of Service (https://play.google.com/intl/en-US_us/about/play-terms/index.html). Where this Agreement and the Google Play Terms of Service conflict, the Google Play Terms of Service govern with respect to your acquisition of the Application through Google Play.

a. Licence. Licensor grants you a personal, non-exclusive, non-transferable, revocable licence to install and use the Application on any Android-powered device that you own or control, solely for your personal, non-commercial purposes and in accordance with this Agreement and the Google Play Terms of Service. The Application is licensed, not sold, to you.

b. Restrictions. You may not: (i) copy the Application except as expressly permitted by this licence; (ii) sell, rent, lease, sublicense, distribute, or otherwise transfer the Application to any third party; (iii) reverse-engineer, decompile, disassemble, or attempt to derive the source code of the Application, except to the extent that such restriction is prohibited by applicable law; or (iv) modify, adapt, or create derivative works of the Application, except as and only to the extent permitted by the licensing terms governing use of any open-sourced components included with the Application.

c. Updates. Licensor may, from time to time, provide updates, upgrades, or new versions of the Application. This Agreement governs any such updates unless the update is accompanied by a separate licence, in which case that licence governs.

d. Consent to Use of Data. You agree that Licensor may collect and use technical data and related information gathered to facilitate the provision of software updates, product support, and other services related to the Application, in a form that does not personally identify you, in accordance with the Application's Privacy Policy.

e. Termination. This Agreement is effective until terminated by you or Licensor. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the Application and delete all copies.

f. No Warranty. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. LICENSOR DISCLAIMS ALL WARRANTIES AND CONDITIONS, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.

g. Limitation of Liability. TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APPLICATION, HOWEVER CAUSED AND REGARDLESS OF THE THEORY OF LIABILITY. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY, SO THIS LIMITATION MAY NOT APPLY TO YOU.

h. Google is not a party. Google is not responsible for the Application or its content. Google is not a party to this Agreement, and any claim you have relating to the Application should be directed to Licensor, not Google. Google is, however, an intended third-party beneficiary of this Agreement and may enforce it against you.

i. Export Compliance. You may not use or otherwise export or re-export the Application except as authorised by the laws of your jurisdiction and of the jurisdiction in which the Application was obtained.

j. Governing Law. This Agreement is governed by the laws applicable at Licensor's principal place of business, excluding its conflict-of-law rules, and without regard to the United Nations Convention on the International Sale of Goods.
